Class Action Lawsuit: Frontier Communications Denies Being Involved
For all those who have recently read about a Class Action lawsuit by Frontier Communications against Starbucks, AT&T and other popular companies, you are probably aware of the case. In July of 2021, Frontier Communications, LLC sued Starbucks, AT&T, and other popular companies such as Verizon, axern, and Alltel.
According to their lawsuit, these companies refused to allow Frontier Communications to connect its customers with cell phones that use GSM technology. Essentially, Frontier Communications claimed that these companies did not have an appropriate contract allowing them to connect customers with wireless devices. This is a rather bold and inaccurate charge, and I would like to present why.
Frontier Communications Class Action Lawsuit
First, let me make something very clear: Companies such as Verizon, AT&T, and Alltel do not dictate who can use GSM cell phones. Frontier Communications, LLC takes issue with the contention that they dictate to a customer who they can use a cell phone. The fact is, that there is no mandate for these companies to allow any particular wireless provider to connect a customer to their service. Furthermore, these companies do not “order” mobile providers to give a cell phone to a person. They simply refuse to provide a cell phone and then sue the carrier.
Now, let me restate the reasons behind this lawsuit.
Frontier Communications’ claims are both legally and morally erroneous. First, the original agreement between Frontier Communications and its customers was that they could use a cell phone to contact the company. That was true, up until Verizon’s terms of the original agreement made it apparent that Verizon could only force customers to use their own service if they purchased a new phone.
Second, even if Verizon had forced customers to continue to use their phones through Verizon’s contract, they would still be liable for damages incurred during use of their phones. Finally, a Class Action lawsuit makes it clear that Frontier Communications has adequate cause to bring this lawsuit against these companies.
As previously stated, the Class Action lawsuit was filed on behalf of all customers who have used Frontier Communications services and have received telephone calls from Verizon.
This Class Action lawsuit also names Frontier Communications’ landlord, which is also named in the complaint. If you’re wondering how a Class Action lawsuit is different from a Class Action lawsuit, here’s how: A Class Action lawsuit is filed on behalf of a group of consumers or clients who have been injured or harmed because of a defective product, while a Class Action lawsuit is filed by an individual or more than one person who has been injured or harmed because of a defective product. Because of the nature of Class Actions, they are generally much faster to resolve than are lawsuits, which is why they are often used.
According to the complaint, Frontier Communications’ policies and practices have caused Frontier to lose millions of dollars in revenue, force its customers to use outdated phones, and force customers to buy phones from other carriers through force-feeding deals.
Also, the Class Action lawsuit says that the phone company targets low-income and minority users and does not provide special services for these markets. Lastly, the Class Action lawsuit claims that the phone company violates the Telephone Consumer Protection Act by forcing customers to buy phones from its subsidiary. This act was designed to protect customers from being ripped-off by companies that do not provide services or products that are advertised. Additionally, the complaint says that Frontier regularly restricts the phone market by selling phones at prices so high that customers cannot afford them.
In a press release issued after the class action lawsuit was filed in January, 2021, Frontier Communications denied any wrongdoing and called the lawsuit “baseless and meritless.
” The company then proceeded to defend its practices, saying, “The class action complaint is simply a re-hash of previous discussions regarding phone service pricing and wireless service contracts with specific customer issues that are already the subject of negotiations with our wireless retailers.” Also, the company said it would “vigorously” fight the case and” prevail against this complaint and any other attempts to defame our company and our service providers.” These statements indicate that Frontier may have difficulty defending against the Class Action lawsuit.
