Class Action Lawsuit – Why Do Not Settle For Less?
The Verizon Class Action Lawsuit is one of the most talked about legal cases in a long time. After a rather strange deposition from Mark Zuckerberg of Facebook, it looks like the attorneys for both sides might have dug up some dirt on one another. That’s one of the many reasons why this case has become so big. A Verizon lawyer actually stated on air that the investigation into Facebook was only done to “assure the Court that we will not file a frivolous lawsuit.” Of course, Verizon didn’t want to admit defeat so their attorney stated they would appeal the ruling.
One interesting piece of information from the hearing was when Mark Zucherberg, Verizon’s attorney, stated that one of the reasons for the massive settlement was due to lack of evidence.
What exactly did he mean by lack of evidence? According to him, Verizon never proofread the settlement offer before accepting it and thus lost a lot of money on the deal. So, in essence, Verizon was getting paid twice for the same deal. It’s just one more example of why settlements in the Class Action type lawsuit are so much money. This is why these deals rarely go through and lawyers rarely win.
Zucherberg continued on with a description of what he thought was the main reason why Verizon would settle such a large case.
He stated that a large number of Verizon customers were dying or moving and he believed this was leading Verizon into the wrong side of the court. Zucherberg did state that he did not understand why Verizon would even settle for a case that was not successful, but he didn’t have anything to argue with. In fact, Verizon will just settle with anyone who is willing to negotiate. The problem is many people will not be able to negotiate a good settlement, especially with a case as complex as this.
The problem lies with Verizon’s willingness to negotiate. We all know that Verizon wants to make more profits and pay out less in fines and penalties. They also want to keep spending money like they are used to. The truth is, they have been getting so good at making money they are not interested in paying out a lot of money in a case that is hopeless. So, they will just walk away.
You might say you were a Verizon customer and that you want fair and square justice in the form of a settlement.
Well, I have some news for you. That is not going to happen. You have no chance of getting anything. Verizon is going to use all of their resources and hire a bunch of lawyers to represent them, regardless of your situation.
When a customer files a lawsuit against a company, the company has to defend themselves.
So, it is obvious from the start that Verizon could not win any case by just paying you a few thousand dollars. They would need to spend millions on attorneys and have judges and jury trial.
So, it is obvious that a settlement would be better for everyone involved. In most cases, a lawyer can get a percentage of the money without having to go into a lengthy court battle.
A Verizon attorney can negotiate with the customer for as little as forty to sixty dollars. This can be done on a monthly basis or until the full amount of the fine is paid. A person that is innocent will still pay the original sum of money, but the customer will not have to pay a penny more.
So, if you have been tried in a Verizon class action lawsuit, then you may want to consider a class action lawsuit. There are many companies out there that handle these types of cases on a regular basis. However, you will still need to hire an attorney that will fight for you and help you get what you rightfully deserve.
